Pennsylvania Attorney General Dave Sunday’s Bureau of Consumer Protection has filed a contempt petition alleging a Philadelphia towing group breached a 2022 court order, the Attorney General’s Office said Thursday.
The petition names Angelina’s Towing and Recovery LLC, Siani’s Towing and Recovery LLC, Aubry’s Towing and Recovery LLC, and Michael Caban Jr. The office is seeking monetary relief totaling more than $220,000.
The Attorney General’s Office sued the companies in 2020 over the same alleged conduct and reached a settlement and court order in 2022. Investigators now allege the defendants continued towing vehicles from areas that were not clearly marked, charged excessive and unlawful towing and storage fees, required consumers to pay in cash or via Cash App, and added extra fees for customers paying by credit card.
“The terms of this settlement were very clear, yet these companies continue to improperly tow consumers’ vehicles, and charge exorbitant fees,” Sunday said in a statement. “Predatory towing is a scourge that causes tremendous anguish and financial burden for the vehicles’ owners, and will not be tolerated.”
The office said the companies have allegedly continued to operate in violation of Pennsylvania’s Unfair Trade Practices and Consumer Protection Law and Philadelphia’s towing law. PhillyVoice reported that an employee who answered the phone at one of Angelina’s lots Thursday morning said the company had no comment.
Anyone who believes they were affected can file a complaint with the Bureau of Consumer Protection by emailing scams@attorneygeneral.gov or calling 1-800-441-2555, the Attorney General’s Office said.
